Agreement
By accessing or using XLClass, you agree to these Terms of Use. Parents or guardians who create accounts for children agree to these terms on behalf of themselves and, where legally appropriate, their child.
XLClass service
XLClass provides an online platform through which students may access educational courses and lessons delivered by instructors. Courses may include music, guitar, piano, keyboard, singing, dance, coding, art, languages, academic enrichment and other extracurricular learning.
Accounts
Users must provide accurate information and are responsible for protecting their account credentials. Accounts must not be transferred or shared without permission.
Children
Children may only use XLClass in accordance with the account and parental consent requirements established by XLClass. XLClass may introduce age specific safety requirements.
Teachers
Teachers may operate as employees, contractors or independent service providers depending on the arrangements applicable to that teacher. XLClass may verify teacher information but cannot guarantee that every statement made by an instructor remains accurate at all times.
Payments
Course prices will be displayed before purchase. Payments may be processed through third party providers including Stripe. Users authorise XLClass and its payment providers to process applicable fees.
Classes
Class schedules, teachers and course content may occasionally change. Where reasonably necessary, XLClass may substitute a teacher, reschedule a lesson, modify course sequencing or cancel a class. An appropriate remedy will be provided where legally required.
Acceptable use
Users must not:
- Attempt to hack XLClass
- Circumvent security measures
- Introduce malware
- Scrape the platform without permission
- Misuse another person’s account
- Harass another user
- Use XLClass for illegal purposes
Intellectual property
The XLClass name, website, branding, software and XLClass produced learning materials are owned by XLClass or its licensors. Teachers may retain ownership of materials they independently create unless otherwise agreed. Purchasing a course does not transfer ownership of intellectual property. Students receive a personal, non commercial right to use authorised learning materials.
Third party services
XLClass may integrate with services such as Zoom, Stripe, email providers, analytics systems and cloud hosting services. Use of those services may also be governed by the provider’s terms.
Platform availability
XLClass aims to provide reliable access but does not guarantee uninterrupted availability. Maintenance, internet outages, third party failures or events outside reasonable control may temporarily affect services.
Suspension and termination
XLClass may restrict or terminate accounts where users seriously breach these terms, create safety risks, commit fraud, harass users, misuse the platform, fail to make required payments or violate child safety rules.
Consumer rights
Nothing in these Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.
Governing law
These Terms are governed by the laws of Victoria, Australia, subject to any rights or laws that cannot legally be excluded.
